Is a business you started before marriage divided in divorce?

If you started your business before tying the knot, you might assume it’s safe from division if you part ways with your spouse. However, this may not be the case. Under Indiana law, all assets each spouse brings into the marriage become marital property and are subject to division in divorce proceedings.

This doesn’t mean your spouse automatically gets half your business. Courts aim to achieve a fair and equitable division of all marital assets.

Factors that could come into play

When deciding whether and how a business will be divided during divorce, the court will look beyond when it was started. Judges also consider the role the other spouse and marital assets played in its growth and operation.

For instance, if marital funds were invested in the business, part of its value could be subject to division. The same applies if your spouse contributed in other ways to the business. Their contributions could be direct, such as bookkeeping or taking on a management role, or indirect, like handling household expenses and responsibilities, so you could focus your time and energy on growing the business.

Providing detailed financial records, proof of when and how the business grew and documentation of any marital contributions can help demonstrate the origins and development of your business. It also makes it easier to separate your personal investments from any marital interests.
