Prenuptial agreements can be the foundation of a healthy marriage

There are many things that engaged couples need to consider before they get married. One of these that’s not often thought of is a prenuptial agreement. While these documents were once used only for the wealthy, they’re becoming more commonplace among married couples these days.

Entering into a prenuptial agreement before your wedding doesn’t mean that you expect the marriage to fail or that there are red flags. Instead, this is a way to ensure that you and your future spouse are both on the same page about finances. 

Benefits of having a prenup

Some of the main benefits of having a prenuptial agreement are that you can protect your rights to your businesses and your inheritances, if they apply. These agreements can prevent one spouse from having to absorb the other spouse’s debts and can lay out protective guidelines for stay-at-home parents.

Considerations when handling the prenup

One thing to remember when you’re handling the prenuptial agreement is that it can’t be presented at the last minute. This is something that you should do well in advance of the wedding so that you and your betrothed have time to review the agreement and seek legal guidance. 

You also have to ensure that things related to children aren’t included. Prenuptial agreements can’t include any terms related to child support or child custody. However, they can include limits on the amount of spousal support that must be paid if the marriage ends.

The prenuptial agreement should be written in a way that is fair for both parties. This helps to ensure that the court won’t consider it one-sided. Working with someone familiar with these matters may help you to determine how to move forward.
